UNDERSTANDING YOUR RIGHTS

Sometimes, discrimination because of national origin or immigration status goes unreported because victims do not understand their legal rights. Other times, victims may be afraid of retaliation if they report discrimination to the government. Therefore, it is critical that citizens and immigrants understand their legal rights and how to exercise them.

Everyone living in the United States has basic rights, including undocumented immigrants. If someone asks a person about his or her immigration status, that person has the right to remain silent. One does not have to answer questions about whether or not one is a US citizen, where he or she was born, or how he or she came to the country. If one has immigration papers, they should be shown to immigration agents if requested. Under no circumstances should one lie about citizenship status or hand over falsified documents.
